Topic: Weird Question????

Everyones knows that Im making a short horror movie that slowly but surely comign along. Now I got an idea to show some skin in the movie. **RIP calm down**
Now im 16 and i know id have to get some 18 year olds in this. But how old do you ahve to be to film some skin?????

I don't know for sure but it makes sense that you would have to be 18+ to film naked 18 yr olds.

I know that the ones being filmed have to be of legal age, but sickfuck wanted to know if he could film someone who is of legal age, when he's 16. Thats what I meant by saying I don't know for sure big_smile

yeah this is just assumption.....but i'm assuming you'd have to be 18 to film it as well.....i mean you can't even go in the naughty room at rental places if your under 18.....so thats my guess.....interesting question though

On your end, as the filmmaker, I can't think of any specific law off the top of my head but I'm fairly certain a juvenile filming a nude adult would be considered a no-no, just on general principle.

On the adult's end, appearing nude for a child carries serious repercussions:  one, a charge of contributing to the delinquency of a minor.  Two, and since nudity is involved, improper/unlawful sexual/lewd conduct with a minor.  Adults charged with this offense usually will have to serve jail time, and are required to register for a minimum of ten years with the NSOR (National Sex Offender Registry) and, by NSOR regulation, will be required to announce their location and charges to neighbors and law enforcement until the ten years NSOR registry has expired.

So, yeah, film yourself some titties if you want the adult to carry a child-related sex offense with them for the rest of their life.  Or, wait until you're an adult before you start worrying about showing skin in your movies.  You should be using this first filmmaking effort as a learning experience, anyway.

I have to agree with LoudLon on this one, you can focus on the plot and FX without doing any nudity and still have a great first film. On the other hand look at the guy who directed the movie K.I.D.S. (Larry Clark I think), there was a lot of controversey around that movie because when he wrote and directed it I believe he was 16 or 17 and there was tons of sex and nudity. It all played into the story but it was there. I'm not sure what to tell you, if it's necessary to the story or is just a flash of boobs or but I think you'll be o.k. but I would hold off on the full frontal or sex scenes for a while.

Well, Clark was 52 when he directed Kids.  Chloe Sevigny was 21 which made her nudity in the film legal.  It's been a while since I've seen it, but I believe it two minors nude (the guy who played Telli was only 17, and I think Rosario Dawson showed nudity and she was only about 16).

When a minor appears nude in a film it's because the filmmakers and law enforcement reps have received written permission by the minor actor's parents.  Parents and a child protective services representative are required to be on set during the filming of the nude minor.  Thora Birch appeared topless at 17 in American Beauty, but it was done so under such conditions. 

But in your case, sick, the roles are reversed - minor filming a nude adult - in a completely unlicensed amateur film.  All the stuff I mentioned earlier applies.  Even if, as the minor, your parents were to give you written permission and were to be present while you filmed the nude scene, a court would still consider your parents to be contributing AND it would be considered misconduct on their part.  They'd be in just as much trouble as the adult you film.

So again, safest bet, wait until you're 18 before filming nudity.

Sounds like a very strong argument Lon, but I am not sure.  I dont really remember much on the "sexual conduct" part of my Criminal Law classes, but I am not sure it witnesses nudity by a minor can really get an adult in trouble.....

But even if that is the case, there are some alternative.....you can get flesh colored pasties for the nipples.  I know it sounds like a dumb idea but they do this in movies sometimes with underage actresses in films, so why not reverse it. 

I just say lose the nudity all together though.  There is enough nudity out there that it really isnt a necessity.  It would just make you like every other film these days.....find another way to stand out or make an impression.

Filming nudity, yes; any adult who willfully allows a minor to photograph them nude, or any adult who willfully allows a child to film an adult nude, has broken the law. 

Sorry to be a stickler but when children, adults and nudity are involved, it shouldn't even be a question.

I guess I dont really understand why this would be different.  So kids can view nudity but they can film it?  Just doesnt seem right.  So basically he could hand the camera to his older brother and let him film it, and he could just direct? Technically he isnt filming it, he is just witnessing it....

true i kept thinkin bout this and ways to get around it. and I was liek wat if i got my bro or an older person to film that and then i watch it. If i dont liek it do a reshoot. Im sure theres a way to get around it

I'm sure there is, too, but not the way suggested.  So what if you're brother's over 18?  You're still a minor, present in the filming of adult nudity, being allowed to participate/watch/what-have-you. 

And yes, child/sexual misconduct laws ARE that nit-picky.  And if you've seen the kind of crap happen to kids that I have in my line of work, you'd COMPLETELY understand why lawmakers are so fickle about this kind of thing.  The laws are in place to protect adults just as much as they are to protect the kids.  And while it may seem innocent enough -- just a kid making a back yard horror movie and -- COOL! -- some legally adult chick let you film her naked -- neither of you understand the severity of it. 

I keep replying to this thread because you really, really need to understand exactly how serious law enforcement and child protective organizations are about this kind of thing.  It may seem like a joke, but they won't treat it -- or you, or her -- like one. 

If none of that convinces you, then look at it from a common sense perspective:  the fact that you doubt the legality of it to begin with should tell you all you need to know.

Seriously, dude -- it's just too much trouble to risk for a nipple shot.
